Terms of Use

Welcome to FunRGB. These Terms of Use govern your access to and use of the FunRGB website, applications, tools, features, content, and related services collectively referred to as the “Service.”

The Service is operated by FunRGB, referred to in these Terms as “FunRGB,” “we,” “us,” or “our.”

By accessing or using the Service, creating an account, publishing content, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility

You may use the Service only if you are legally capable of entering into a binding agreement under the laws applicable to you.

If you are under the age of legal majority in your country, you may use the Service only with the permission and supervision of a parent or legal guardian. The parent or legal guardian is responsible for your use of the Service.

You must not use the Service if applicable law prohibits you from doing so.

2. The FunRGB Service

FunRGB provides tools and resources related to colors, color palettes, gradients, visual design, and related creative content.

Depending on the features available to you, the Service may allow you to:

  • create colors, color palettes, and gradients;
  • save and organize created content;
  • publish and share content with other users;
  • download or export generated content;
  • browse content published by FunRGB or other users;
  • access free and paid tools or features; and
  • purchase a subscription providing access to additional functionality.

We may add, modify, restrict, suspend, or discontinue any part of the Service at any time. Where required by applicable law, we will provide reasonable notice before making a material change that adversely affects a paid subscription.

3. User Accounts

Some features may require you to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activity conducted through your account;
  • using a secure password; and
  • promptly notifying us if you suspect unauthorized access to your account.

You must not share, sell, transfer, rent, or otherwise provide access to your account to another person without our permission.

We may require you to verify your email address or other account information. We may reject or require you to change a username, profile name, or other account identifier that is misleading, unlawful, offensive, or infringes another person’s rights.

4. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms.

You must not:

  • violate any applicable law or regulation;
  • use the Service to infringe intellectual property, privacy, publicity, contractual, or other rights;
  • publish unlawful, fraudulent, defamatory, threatening, abusive, hateful, discriminatory, sexually exploitative, or otherwise harmful content;
  • impersonate another person or misrepresent your identity or affiliation;
  • upload malware, malicious code, corrupted files, or other harmful technology;
  • attempt to gain unauthorized access to the Service, another account, or any related system or network;
  • interfere with or disrupt the operation, security, performance, or availability of the Service;
  • circumvent access restrictions, subscription limitations, rate limits, or security measures;
  • use automated tools to scrape, crawl, extract, or collect data from the Service without our prior written permission;
  • reverse engineer, decompile, disassemble, or attempt to discover the source code of any non-public part of the Service, except where such restriction is prohibited by law;
  • use the Service to send spam, unsolicited advertising, or deceptive communications;
  • artificially manipulate views, likes, saves, rankings, recommendations, or other engagement metrics;
  • use the Service in a way that imposes an unreasonable load on our infrastructure; or
  • assist another person in performing any prohibited activity.

5. User Content

“User Content” means any content that you create, upload, save, submit, publish, or otherwise make available through the Service. User Content may include colors, color combinations, palettes, gradients, titles, descriptions, tags, images, profile information, and related materials.

You retain any ownership rights that you may have in your User Content. These Terms do not transfer ownership of your User Content to FunRGB.

You are solely responsible for your User Content and for the consequences of publishing or sharing it.

By submitting User Content, you represent and warrant that:

  • you created the User Content or have all permissions necessary to use and publish it;
  • the User Content does not infringe or violate the rights of any person or entity;
  • the User Content complies with these Terms and applicable law; and
  • the information associated with the User Content is not materially false or misleading.

6. License to User Content

To operate and provide the Service, you grant FunRGB a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, adapt, format, publish, display, distribute, and make your User Content available through the Service.

This license allows us to:

  • display your published content to other users;
  • create previews, thumbnails, exports, and technically modified versions;
  • distribute content through different devices and technical formats;
  • operate search, discovery, recommendation, and sharing features; and
  • promote the Service by displaying publicly available User Content in FunRGB marketing materials, social media posts, and promotional communications.

This license is limited to the purposes of operating, improving, securing, and promoting the Service. It does not permit FunRGB to sell ownership of your User Content to another person.

The license continues for as long as your User Content remains available through the Service. When you delete User Content, the license will generally end after a reasonable period required to remove the content from active systems. Copies may remain temporarily in backups, caches, shared publications, legal records, or systems where immediate deletion is technically impracticable.

7. Public Content and Reuse by Other Users

User Content that you publish publicly may be viewed, saved, copied, downloaded, referenced, or shared by other users.

FunRGB does not control how third parties use content after it has been made public or exported from the Service. You should publish content only if you are comfortable making it publicly available.

Unless a separate license is clearly displayed, publication through FunRGB does not automatically grant other users ownership of your User Content. Users remain responsible for determining whether their intended use of any content is lawful and whether additional permission is required.

8. Content Moderation

We are not required to review all User Content before it is published. However, we may review, restrict, hide, remove, disable access to, or refuse to publish User Content when we reasonably believe that it:

  • violates these Terms or applicable law;
  • infringes another person’s rights;
  • creates a security, legal, or reputational risk;
  • is misleading, fraudulent, abusive, or harmful;
  • interferes with the operation or quality of the Service; or
  • is otherwise inappropriate for the Service.

We may use automated systems and manual review to detect prohibited content or activity. Automated systems may occasionally make errors.

Where appropriate and required by law, you may contact us to request information about a moderation decision or to appeal that decision.

9. Intellectual Property Rights

The Service and its original content, software, source code, interfaces, databases, visual design, graphics, text, logos, trademarks, and other materials, excluding User Content, are owned by or licensed to FunRGB and are protected by applicable intellectual property laws.

Subject to these Terms, FunRGB grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purposes.

This license does not give you permission to:

  • copy or redistribute substantial parts of the Service;
  • use FunRGB trademarks, branding, or logos without written permission;
  • sell, license, or commercially exploit access to the Service itself;
  • create a competing database by systematically extracting FunRGB content or data; or
  • remove copyright, trademark, attribution, or proprietary notices.

No rights are granted except those expressly stated in these Terms.

10. Intellectual Property Complaints

We respect intellectual property rights and expect users to do the same.

If you believe that content available through the Service infringes your copyright or another intellectual property right, please send a notice to [email protected] containing:

  • your full name and contact information;
  • identification of the protected work or right;
  • the URL or other precise location of the allegedly infringing content;
  • an explanation of why you believe the content is infringing;
  • a statement that the information in your notice is accurate;
  • a statement that you are the rights holder or authorized to act on behalf of the rights holder; and
  • your physical or electronic signature.

We may remove or restrict access to disputed content and may terminate accounts belonging to users who repeatedly infringe intellectual property rights.

11. Free Features

FunRGB may provide certain features free of charge. Free features may be subject to limits relating to storage, exports, usage volume, formats, availability, or other functionality.

We may change or discontinue free features at any time. The availability of a free feature does not guarantee that it will remain free or available permanently.

12. Paid Subscriptions

FunRGB may offer paid subscriptions that provide access to advanced tools, increased limits, additional storage, export options, or other premium functionality.

The specific features, billing period, currency, price, applicable taxes, and other subscription conditions will be displayed before you complete your purchase.

By purchasing a subscription, you authorize FunRGB and its payment service providers to charge the applicable fees using your selected payment method.

Except where otherwise stated, subscriptions are personal and may not be shared, transferred, resold, or used to provide access to unrelated third parties.

13. Automatic Renewal

If your subscription is described as automatically renewing, it will renew at the end of each billing period unless you cancel it before the renewal date.

By purchasing an automatically renewing subscription, you authorize us to charge the applicable renewal price and taxes to your selected payment method at the beginning of each new billing period.

The renewal price will be the price disclosed when you purchased the subscription unless we notify you of a price change in accordance with these Terms and applicable law.

14. Subscription Cancellation

You may cancel your subscription through your account settings or by following the cancellation instructions provided by FunRGB.

Cancellation stops future renewals. Unless applicable law or the specific subscription terms provide otherwise, you will retain access to paid features until the end of the billing period for which you have already paid.

Deleting the FunRGB application, ceasing to use the Service, or deleting content does not automatically cancel a subscription. You must complete the applicable cancellation process.

If you purchased your subscription through a third-party platform or application store, you may need to cancel it through that provider.

15. Prices and Taxes

Subscription prices may vary by country, currency, billing period, promotional offer, or sales channel.

Prices displayed before purchase will indicate whether applicable taxes are included. You are responsible for taxes, duties, bank fees, currency conversion fees, or similar charges associated with your purchase, except where we are legally required to collect them directly.

We may change subscription prices. Price changes will normally apply from a future billing period and will be communicated in advance where required by applicable law.

16. Payments

Payments may be processed by third-party payment service providers. Your use of their services may be governed by separate terms and privacy policies.

You agree to provide accurate and authorized payment information. If a payment cannot be completed, we may suspend or restrict access to paid features until payment is successfully received.

We are not responsible for fees charged independently by your bank, payment provider, card issuer, application store, cryptocurrency network, or other intermediary.

17. Refunds

Except where required by applicable law or expressly stated during purchase, subscription payments are non-refundable.

We generally do not provide refunds or credits for:

  • partially used billing periods;
  • unused subscription features;
  • failure to cancel before a renewal date;
  • temporary interruptions that do not materially prevent use of the Service; or
  • account restrictions resulting from a violation of these Terms.

Nothing in these Terms limits any mandatory cancellation, withdrawal, refund, repair, replacement, price reduction, or other consumer right available under applicable law.

Refund requests may be submitted to [email protected]. If a purchase was processed by a third-party platform, refund requests may need to be submitted directly to that platform.

18. Trials and Promotional Offers

FunRGB may offer free trials, discounted subscriptions, promotional access, or other special offers. Additional conditions may apply and will be disclosed when the offer is presented.

Unless otherwise stated, a trial may convert into a paid subscription at the end of the trial period. Where this applies, the renewal price and billing terms will be disclosed before you begin the trial.

You must cancel before the stated deadline to avoid being charged. Promotional offers may be limited to eligible users and may not be combined, transferred, exchanged, or redeemed for cash.

19. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites, services, libraries, platforms, payment providers, social networks, or applications.

FunRGB does not own or control these third-party services and is not responsible for their content, availability, security, conduct, products, or privacy practices.

Your use of a third-party service is governed by the terms and policies of that third party. Accessing a third-party service through FunRGB does not constitute an endorsement.

20. Service Availability and Changes

We aim to provide a reliable Service, but we do not guarantee uninterrupted, secure, error-free, or permanent availability.

The Service may be unavailable because of maintenance, updates, technical failures, security incidents, network conditions, third-party service failures, or circumstances beyond our reasonable control.

We may introduce, change, limit, or remove features to improve the Service, comply with law, address security concerns, or reflect technical and commercial requirements.

21. Generated Results and Color Accuracy

Colors, gradients, palettes, conversions, accessibility calculations, previews, recommendations, and other results produced by the Service are provided as creative and technical tools.

Displayed colors may vary depending on the screen, device, browser, operating system, color profile, brightness, lighting conditions, printer, ink, material, manufacturing process, and other factors.

You are responsible for reviewing and testing generated results before using them in production, printing, manufacturing, branding, accessibility compliance, safety-critical systems, or commercial projects.

FunRGB does not guarantee that generated results will be accurate, unique, suitable for a specific purpose, legally protectable, or free from similarity to content created by other users or third parties.

22. Feedback

If you provide ideas, suggestions, comments, feature requests, or other feedback about FunRGB, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, reproduce, modify, develop, publish, and otherwise exploit that feedback without compensation or obligation to you.

This section does not apply to User Content that you publish through the ordinary content creation features of the Service.

23. Suspension and Termination

You may stop using the Service at any time. You may request deletion of your account using the available account controls or by contacting us.

We may suspend, restrict, or terminate your account or access to the Service if:

  • you violate these Terms;
  • you fail to pay applicable fees;
  • your activity creates a security, legal, or operational risk;
  • we are required to do so by law or a valid legal request;
  • your account has been inactive for an extended period, following notice where appropriate; or
  • we discontinue the Service.

Where reasonable and legally permitted, we will attempt to provide notice and an opportunity to correct the issue before termination. Immediate action may be taken when necessary to protect users, third parties, FunRGB, or the security and integrity of the Service.

After termination, your right to use the Service ends immediately. Provisions that by their nature should continue after termination will remain in effect, including provisions concerning intellectual property, licenses already granted, payment obligations, disclaimers, limitations of liability, indemnification, and dispute resolution.

24. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the Service, you acknowledge that your information will be processed as described in the Privacy Policy and as permitted by applicable law.

25. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

FunRGB disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security.

We do not warrant that:

  • the Service will meet your specific requirements;
  • the Service will always be available, uninterrupted, secure, or error-free;
  • all defects or errors will be corrected;
  • generated or published content will be accurate, unique, lawful, or suitable for your intended use; or
  • User Content or other data will never be lost, damaged, altered, or accessed without authorization.

Some jurisdictions do not permit the exclusion of certain warranties. In those jurisdictions, these exclusions apply only to the extent permitted by law.

26. Limitation of Liability

To the maximum extent permitted by applicable law, FunRGB and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes loss of profits, revenue, business opportunities, goodwill, data, content, subscriptions, or anticipated savings arising from or related to:

  • your access to or use of the Service;
  • your inability to access or use the Service;
  • User Content or third-party conduct;
  • unauthorized access to your account or data;
  • errors in generated colors, palettes, gradients, calculations, or exports; or
  • changes, suspension, or discontinuation of the Service.

To the maximum extent permitted by applicable law, FunRGB’s total aggregate liability for all claims relating to the Service will not exceed the greater of:

  • the amount you paid to FunRGB during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

27. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FunRGB and its owners, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • your User Content;
  • your use or misuse of the Service;
  • your violation of these Terms;
  • your violation of applicable law; or
  • your infringement of another person’s rights.

This obligation does not apply to the extent that a claim was caused by FunRGB’s own unlawful conduct.

28. Changes to These Terms

We may update these Terms to reflect changes to the Service, our business practices, legal requirements, security standards, or other operational needs.

When we make changes, we will update the effective date at the top of this page. If a change materially affects your rights or obligations, we may provide additional notice through the Service, by email, or by another reasonable method.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires additional consent.

If you do not agree to the updated Terms, you must stop using the Service and cancel any subscription before its next renewal.

29. Governing Law

These Terms are governed by the laws of __, without regard to its conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in ___, unless applicable consumer law gives you the right to bring a claim in another jurisdiction.

Nothing in this section deprives you of any mandatory protection provided by the laws of your country of residence.

30. Informal Dispute Resolution

Before starting formal legal proceedings, you agree to contact us at [email protected] and provide a reasonable description of the dispute and the requested resolution.

We will attempt to resolve the dispute in good faith. This requirement does not prevent either party from seeking urgent injunctive relief or exercising a right that cannot legally be restricted.

31. General Provisions

These Terms, together with the Privacy Policy and any additional terms presented for a specific feature or purchase, constitute the entire agreement between you and FunRGB regarding the Service.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

Our failure to enforce any provision is not a waiver of our right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or transfer of the Service.

Headings are provided for convenience and do not affect the interpretation of these Terms.
